These terms govern use of PaymentPutty, a BigCommerce app operated by MoJo Active, Inc. ("MoJo Active", "we", "us"), the website www.paymentputty.com, and any messages we send on a merchant's behalf. By installing or using PaymentPutty, or by interacting with a PaymentPutty feature on a merchant's store, you agree to these terms.

1. The service

PaymentPutty adds checkout, order, and notification features to BigCommerce stores. Merchants choose which features to enable and how they are configured. We provide the app "as is" and may change or discontinue features with reasonable notice to merchants.

2. Merchant accounts

You must have authority to install apps on the BigCommerce store you connect. You are responsible for your configuration, for the content of any messages sent through PaymentPutty on your behalf, and for complying with the laws that apply to your store and your customers, including consumer protection, privacy, and messaging laws.

3. Fees and billing

Subscription and add-on fees are shown in the app and billed through BigCommerce or Stripe. Usage-based features, such as gift message delivery, are billed monthly based on messages sent. Fees are non-refundable except where required by law. We may suspend features for accounts with overdue balances after notice.

4. Acceptable use

You may not use PaymentPutty to send unsolicited or deceptive messages, to collect data you are not entitled to collect, to infringe anyone's rights, or to interfere with the service. We may suspend or terminate accounts that violate these terms.

5. SMS Terms

This section applies to text messages sent by PaymentPutty on behalf of participating merchants.

  • Program description. PaymentPutty (MoJo Active, Inc.) sends transactional gift message texts when a purchaser adds a gift message at checkout, provides the recipient's US mobile number, and confirms the recipient's consent to receive one text message. Messages contain the store name, the sender's name, and the sender's message.
  • Message frequency. One message per gift. No recurring messages.
  • Sending number. Messages are sent from (412) 467-0145.
  • Message and data rates may apply.
  • Opt out. Reply STOP at any time to stop receiving messages from this number. You will receive one confirmation text and no further messages. Opting out applies across all merchants that use PaymentPutty.
  • Help. Reply HELP for help, or contact [email protected].
  • Carriers. Carriers are not liable for delayed or undelivered messages.
  • Privacy. See our Privacy Policy at https://www.paymentputty.com/privacy. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.

6. Email delivery

Merchants may send transactional emails through PaymentPutty from a domain they verify. Merchants are responsible for the content of those emails and for maintaining the DNS records needed for delivery.

7. Data

Our Privacy Policy explains what we collect and how we use it. Merchants are the controllers of their shoppers' data and instruct us to process it to provide the service. We will not use shopper data for any other purpose.

8. Intellectual property

PaymentPutty, its code, and its branding belong to MoJo Active, Inc.. Merchants keep all rights to their store content and data. You may not copy, reverse engineer, or resell the app.

9. Warranties and liability

The service is provided without warranties of any kind, express or implied, including fitness for a particular purpose. To the fullest extent permitted by law, MoJo Active's total liability for any claim arising from the service is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages, or for delayed or undelivered messages.

10. Indemnity

Merchants will indemnify MoJo Active against claims arising from their store, their content, their configuration of the service, or their violation of these terms or applicable law.

11. Termination

Merchants may uninstall PaymentPutty at any time. We may terminate or suspend access for breach of these terms. Sections 5, 7, 8, 9, and 10 survive termination.

12. Governing law

These terms are governed by the laws of the State of PA, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in PA.

13. Changes

We may update these terms. We will post changes on this page and update the date above. Continued use after a change means you accept the new terms.
